Sexual Assault Defense Lawyer Explains The Lawsuits Against Diddy
With highly televised raids on March 25th stretching quite literally from coast to coast in Florida and California, the cases against rapper and producer Sean ‘Diddy’ Combs can truly be said to be national.
While the moguls of the coasts and their legal problems might seem like distant issues to Kansas residents, the lawsuits Diddy is involved in and the law enforcement response to them reveal several important lessons for anyone accused of sexual assault or similar crimes.

What Is Sean Diddy Combs Even Accused Of Anyways?
At this point, the question might more rightly be phrased as “What isn’t Diddy accused of?”
While one lawsuit against Diddy was successfully settled with the accuser, Cassie Ventura, there have been at least six more, several of which bear similar accusations and allegations. They include:
- Assault
- Sexual assault
- Aggravated assault
- Rape
- Trafficking (human, firearms, and narcotics!)
- A host of drug-related crimes
- Intimidation and coercion
- And plenty more.
Some accusations go back decades, while others have allegedly taken place as recently as the last few years. All have been denied vocally and categorically by Diddy and his lawyers. While Diddy would be entitled to a presumption of innocence in court, the same cannot be said of the court of public opinion, which has come down pretty hard on Mr. Combs.
Even other rappers as famous as Eminem have been taking potshots at him by including the allegations in song lyrics and making statements online.
And yet, even with all these allegations, is P Diddy in jail? No – at least, not yet.
Why Has Diddy Not Been Arrested Yet?
With all the crimes and accusations, especially those echoed in the media or backed up by leaked video evidence like the tape of him striking and dragging Cassie Ventura, it is only natural to ask whether Mr. Combs will be going to jail. And for plenty in Kansas, why isn’t he there yet?
There are actually several reasons why, as defense attorney Paul Cramm explains:
1. Diddy Saved By The Statute Of Limitations?
Many of the alleged crimes were committed long enough ago, including the assault on Cassie Ventura caught on video, that the legal delay in which to charge someone for them (the statute of limitations) has passed or expired.
This makes it difficult, or even legally impossible, for law enforcement to charge him with those crimes.
This does not apply to all allegations, however. At least two of the lawsuits were (conveniently) filed just before the expiration date on a special New York law that allowed sexual assault and rape victims to bring forward accusations that would normally have expired.
2. Is There A Federal Case Against Diddy In The Works?
Another possible explanation that would apply across all the lawsuit allegations, sometimes even despite the statute of limitations, is the probability that federal law enforcement wants to bring a larger case against Mr. Combs.
A case like this, likely pursued under federal RICO laws typically used for prosecuting organized crime, would enable the government to consolidate multiple allegations and present evidence, even from instances where the statute of limitations has expired, to prosecute Diddy, his entourage, and some of his children for a wide range of crimes.
Such tactics have been popular when used against other rappers, like R Kelly, and are currently being used in Georgia against Young Thug and his YSL music label (accused of gang activity).
This interpretation is consistent with the two massive raids on Sean Combs’ homes, in which considerable evidence may have been seized, even if no arrests were made against Mr Combs or his sons at the time.
3. Is There A Lack Of Evidence Against Sean Diddy Combs?
An alternative explanation would be that law enforcement, at any level, lacks sufficient evidence to charge and prosecute Mr Combs for any of these alleged crimes. The simple testimony laid forward in the lawsuits may not be sufficient from a legal standpoint; why else would they do the raids after all if they did not need more hard evidence?
Several of the lawsuits allege tapings of some of the incidents described, and the March 25th raids may have been aiming to recover some, or all, of that video evidence. Unfortunately, if they did find anything damning, law enforcement has been quite cagey with their results.
Furthermore, after the raids, one of Diddy’s alleged ‘drug mules,’ Brendan Paul, was arrested on drug charges. This suggests that if there was evidence in the state’s possession if they had found anything damning, they might have acted right away to put Diddy behind bars. Diddy’s lawyers even claim that the evidence is solidly on their side, though that remains to be seen.
It does bring up one more possible explanation.
4. Are Diddy’s Criminal Defense Attorneys Keeping Him Out Of Jail?
If there is one thing that is certain in the case so far, Diddy’s lawyers are good. His team of attorneys has consistently been on top of the news cycle, spinning the story to make the government and any accusers look bad while keeping Diddy’s name as clear as possible and coming after anyone who goes too far in accusing him openly.
While there is no way to know whether it is their work that is keeping the rapper out of jail, there can be no doubt it is helping. Indeed, having a good attorney on your side, regardless of whether you are a famous music mogul in Miami, or a hard-working father of two in Kansas City, is crucial.
